1 ـ هسته و مغز هسته میوه نخل، پنبه دانه، تخم کرچک، تخم کنجد، دانه خردل، تخم گلرنگ یا زعفرانکاذب (Safflower seeds)، دانه خشخاش و دانهکاریته (Karite nuts)، مخصوصاً به مفهوم شماره 07 12 دانههای روغندار محسوب میشوند. برعکس، محصولات شمارههای 01 08 و
02 08 و همچنین زیتون (فصل 7 یا فصل 20) از این شماره مستثنی میشود.
2 ـ شماره 08 12 نه تنها شامل آرد و زبرههای روغنگرفته نشده میشود بلکه آردها و زبرههایی را که قسمتی از روغنشانگرفتهشده و سپسکلاً یا جزئاً روغن اصلیشان به آنها افزوده شده در بر میگیرد. برعکس، تفالههای شمارههای 04 23 لغایت 06 23 از این شماره مستثنی میشوند.
3 ـ تخم چغندر، تخم چمن و تخم سایر علفها، تخم گلهای زینتی، تخم سبزیهای جالیزی، تخم درختان جنگلی، تخم درختان میوه، دانه ماش (غیر از آنهاییکه ازگونه ویسیافابا (VICIA faba) هستند و تخم باقلای مصری (ترمس Lupines) جزء «بذرها برای کشت» شماره 09 12 محسوب میشوند.
برعکس محصولات زیر از شماره 09 12 مستثنی میشوند، حتی اگر به جای بذر مورد استفاده قرارگیرند:
الف ـ سبزیجات غلافدار و ذرت شیرین (فصل 7)؛
ب ـ ادویه و سایر محصولات فصل 9؛
ج ـ غلات (فصل 10)؛
د ـ محصولات مشمول شمارههای 01 12 لغایت 07 12 یا 11 12.
4 ـ شماره 11 12 «بویژه» شامل نباتات و اجزاء نباتات از انواع زیر میباشد:
ریحان، گل گاوزبان، جنسن (Ginseng)، زوفا، شیرین بیان، انواع مختلف نعناع و پونه، ناخنک یا اکلیل کوهی (Rosemary)، سداب (Rue)، بهمن سرخ (Sage) و افسنتین (خاراگوش).
برعکس، محصولات زیر از شماره 11 12 مستثنی میشوند:
الف ـ محصولات دارویی فصل 30؛
ب ـ فرآوردههای عطرسازی، یا آرایشی یا پاکیزگی فصل 33؛
ج ـ حشرهکشها ،قارچکشها، علفکشها،گندزداها و محصولاتهمانندمشمول شماره 08 38.
5 ـ بهمفهوم شماره 12 12، اصطلاح «خزه و جلبک و سایر علفهای دریایی» شامل موارد زیر نمیشود:
الف ـ موجودات ذرهبینی تک سلولی مرده مشمول شماره 02 21؛
ب ـ کشتهای موجودات ذرهبینی مشمول شماره 02 30؛
ج ـ کودهای مشمول شماره 01 31 یا شماره 05 31.
یادداشت شماره فرعی
1 ـ به مفهوم شماره فرعی 10 1205، اصطلاح «دانههای منداب یا لفت دارای مقدار کمی اسید اروسیک» (Low erucic acid Rape or Colza seeds) شامل دانههای منداب یا لفتی میشود که روغن ثابتی بهدست دهند که میزان اسید اروسیک آن از لحاظ وزن کمتر از 2% و جزء متشکله جامد آن در هر گرم حاوی کمتر از 30 میکرومول از گلوکوزینولاتها باشد.
مندرجات ذیل یادداشت فصل 12
1ـ ورود و ترخیص موکول به رعایت ماده 16 قانون مواد خوردنی و آشامیدنی مصوب 1346 میباشد.
2ـ ورود اقلام مشمول این فصل موکول به رعایت ماده 11 قانون حفظ نباتات مصوب 1346 است.
3- حقوق ورودی بذر دانههای روغنی، چغندرقند، پنبه، گیاهان علوفهای، مرتعی و چمن 4 درصد ارزش میباشد.
4ـ ورود دانه و آرد خشخاش ممنوع میباشد.
5- ورود بذر و نباتات که در اسناد صدور کشور مبدأ مشخصاً دستورزیشده محسوب میشوند یعنی با تغییرات ژنتیکی تولید شدهاند از لحاظ بررسی خطرات زیستمحیطی موکول به تایید سازمان حفاظت محیط زیست میباشد.
6- صدور بذر و نهال در مقیاس تجاری منوط به اخذ گواهی از مؤسسه تحقیقات ثبت و گواهی بذر و نهال و با رعایت مقررات قرنطینه میباشد.
7- ورود و صدور گیاه و اجزای مختلف گیاه شاهدانه (Cannabis) و همچنین برگ کوکا و کاه خشخاش ممنوع است.
Chapter 12
Oil seeds and oleaginous fruits; miscellaneous grains, seeds and fruit; industrial or medicinal plants; straw and fodder
Notes.
1. Heading 12.07 applies, inter alia, to palm nuts and kernels, cotton seeds, castor oil seeds, sesamum seeds, mustard seeds, safflower seeds, poppy seeds and shea nuts (karite nuts). It does not apply to products of heading 08.01 or 08.02 or to olives (Chapter 7 or Chapter 20).
2. Heading 12.08 applies not only to non-defeated flours and meals but also to flours and meals which have been partially defatted or defatted and wholly or partially refatted with their original oils. It does not, however, apply to residues of headings 23.04 to 23.06.
3. For the purposes of heading 12.09, beet seeds, grass and other herbage seeds, seeds of ornamental flowers, vegetable seeds, seeds of forest trees, seeds of fruit trees, seeds of vetches (other than those of the species Vicia faba) or of lupines are to be regarded as "seeds of a kind used for sowing".
Heading 12.09 does not, however, apply to the following even if for sowing:
(a) Leguminous vegetables or sweet corn (Chapter 7);
(b) Spices or other products of Chapter 9;
(c) Cereals (Chapter 10); or
(d) Products of headings 12.01 to 12.07 or 12.11.
4. Heading 12.11 applies, inter alia, to the following plants or parts thereof: basil, borage, ginseng, hyssop, liquorice, all species of mint, rosemary, rue, sage and wormwood.
Heading 12.11 does not, however, apply to:
(a) Medicament's of Chapter 30;
(b) Perfumery, cosmetic or toilet preparations of Chapter 33; or
(c) Insecticides, fungicides, herbicides, disinfectants or similar products of heading 38.08.
5. For the purposes of heading 12.12, the term "seaweeds and other algae" does not include:
(a) Dead single-cell micro-organisms of heading 21.02;
(b) Cultures of micro-organisms of heading 30.02; or
(c) Fertilisers of heading 31.01 or 31.05.
Subheading Note.
1. For the purposes of subheading 1205.10, the expression "low erucic acid rape or colza seeds" means rape or colza seeds yielding a fixed oil which has an erucic acid content of less than 2% by weight and yielding a solid component which contains less than 30 micromoles of glucosinolates per gram.
Explanatory remarks to Chapter 12
1. Importation and clearance shall be subject to the observance of Article 16 of the Law on Foodstuffs and Beverages enacted in 1967.
2. The importation of items covered by this chapter is subject to the observance of Article 11 of the Plant Protection law adopted in 1967.
3. The import duty on seeds of oil seeds, sugar beet seeds, cotton seeds, seeds of forage plants, pasture plants and lawn grass is 5% of the value.
4. The importation of poppy seed and its flour is prohibited.
The entry of seeds and plants which, according to the export documents of the country of origin, have been identified as genetically modified shall be subject to the approbation of the Environment Protection Organization in terms of any environmental dangers.
The exportation of seeds and saplings on a commercial scale shall be subject to a certificate obtained from the Institute for the Research, Registration and Certification of Seed and Sapling, and to the compliance with the quarantine regulations.
7. The importation and exportation of cannabis plant and parts there of, coca leaf and poppy straw are prohibited ().
